1. New Federal Protections Under VAWA (Sept 2024 Reaffirmation)
One of the biggest hurdles survivors face is a "bad" record, maybe an eviction because of a domestic disturbance, or a criminal record related to defending yourself. For a long time, these were used as reasons to deny housing.
But here is the win: Federal agencies have recently doubled down on the Violence Against Women Act (VAWA) Housing Provisions.
What this means for you:
- No Denials Based on Abuse: You cannot be denied housing assistance or evicted because of circumstances directly related to the abuse you’ve suffered.
- Self-Certification: You don’t need a mountain of police reports to prove your situation. You can use HUD Form HUD-5382 to self-certify your status as a survivor.
- Emergency Transfers: If your current housing is no longer safe because of your abuser, you have the right to request an emergency transfer to a different unit or even a different area.

2. The Expansion of Emergency Housing Vouchers (EHVs)

Under the latest guidelines, if you have a Section 8 Housing Choice Voucher, you have "portability" rights. As a domestic violence survivor, you can move to a different jurisdiction, even if your lease isn't up, and maintain your housing assistance.
This flexibility is a lifesaver. It means your abuser can’t use your housing benefits as a tether to keep you in one place. You have the right to move, the right to hide, and the right to start over in a place where you aren't looking over your shoulder.
